Searer Business Technology Inc. (“SBT”), owner and operator of SBTExecutiveSeries.com (the “Site”) and the services provided via the Site (“Services”), is committed to customer service and we intend to provide a private and secure experience on the Site. The following privacy notice (this “Privacy Notice”) will help each person who uses the Site or Services (“you” or “your”) including each authorized user (“User”) or any entity that has entered a written agreement with SBT (“Company”) to understand how SBT and its agents and representatives (collectively, “SBT,” “we,” “us,” or “our”) collect, use, share and otherwise handle information that you may provide through the Site or other communications with us.

INFORMATION WE COLLECT FROM YOU

We or our vendors (such as the company that hosts the Site) collect different types of information from you when you visit the Site or otherwise communicate with us.

Personal Information

. In order to use our Services, you need to register for an Account. We collect certain information from you, including (but not limited to): your first and last name; your full address and telephone number(s); your email address (which may function as your user name) and password of your choice. We may also collect other information, including any information required by the Company paying for an Account. We treat all of the foregoing information identified in this paragraph as “Personal Information” for purposes of this Privacy Notice.

BY PROVIDING ANY INFORMATION AND/OR UPLOADING IMAGES, VIDEO, LINKS OR DOCUMENTS RELATING TO YOU OR ANOTHER PERSON, YOU AFFIRMATIVELY REPRESENT TO US THAT YOU HAVE ALL RIGHTS NECESSARY TO SHARE AND TO GRANT A LICENSE TO SBT TO USE ALL CONTENT, INCLUDING THE RIGHT FOR YOU TO DISCLOSE THE INFORMATION AND TO AUTHORIZE US TO USE AND DISCLOSE THE INFORMATION OF ANY OTHER PERSON WHOSE INFORMATION YOU PROVIDE TO USE.

Anonymous Information

When you access or use the Site, we also collect certain anonymous, non-personal information (“Anonymous Information,” as further defined in the ANONYMOUS INFORMATION section below) about your computer hardware and software that enables us to, among other things, provide quality Services to you and enhance your experience in using the Site. (See ANONYMOUS INFORMATION section below for how we use and share this information.) WE DO NOT TREAT ANONYMOUS INFORMATION AS PERSONAL INFORMATION FOR PURPOSES OF THIS PRIVACY NOTICE.

HOW WE USE YOUR PERSONAL INFORMATION

We may use your Personal Information in a variety of ways, including:

1) To operate and improve the Site;

2) To deliver and improve the Services;

3) To facilitate your payment transactions related to your purchases of the Services or other goods or services requested by you;

4) To facilitate the uploading of SBT Content, and to otherwise verify the User associated with SBT Content;

5) To contact you about updates to the Site and/or the Services;

6) For internal business analysis and other internal business purposes; or

7) To contact you about other products, services and promotions offered by us, unless you have previously opted out of such disclosures (see YOUR OPT-OUT RIGHTS section below).

HOW WE SHARE YOUR PERSONAL INFORMATION

We will not sell, rent or lease your Personal Information to third parties. We will not disclose your Personal Information to third parties for purposes of marketing any third parties’ products or services without first obtaining your consent. We may disclose your Personal Information, without notice, to third parties in the following instances:

1) We have your consent to do so;

2) The disclosure helps us deliver the Services to you;

3) The disclosure is to your chosen payment provider to fulfill purchases of the Services requested by you;

4) The disclosure is to one of our vendors or “Affiliates” (defined as other entities that control us, are controlled by us, or are under common control with us, whether the control results from equity ownership, contract, overlapping management or otherwise) for the limited purpose of helping us carry out the functions set forth in this section and/or the HOW WE USE PERSONAL INFORMATION section above;

5) The disclosure is otherwise consistent with the purpose for which the Personal Information was provided to us;

6) The Personal Information is publicly available;

7) The disclosure is reasonably related to the sale or other disposition of all or part of our business or assets;

8) When we believe, in our sole discretion, that the disclosure is necessary to comply with applicable law;

9) When we believe, in our sole discretion, that the disclosure is necessary to respond to legal process, including subpoenas, served on us by a third party, or to respond to a request or demand for assistance from law enforcement or a government agency;

10) When we believe, in our sole discretion, that the disclosure is necessary to protect and defend the rights or property of SBT, or any third parties;

11) When we believe, in our sole discretion, that you, a User or a Company is engaging in illegal activities; or

12) The disclosure is otherwise permitted by law.

Our vendors and Affiliates are prohibited from using or sharing any Personal Information received from us in a way that is inconsistent with the purpose(s) for which the Personal Information was shared with them.

YOUR OPT-OUT RIGHTS

You have the right to opt out of receiving marketing communications (whether through mail, telephone or email) from us or any of our Affiliates or vendors regarding other products, services and promotions available from us. To opt out of all marketing emails, please click the link contained in any such emails sent by us or our Affiliates or vendors. If you have difficulties opting out of such emails, or if you would like to opt out of receiving marketing communications through the mail or telephone, please contact us (see CONTACT US section below). In your request (whether by mail, telephone or email), please specify the type of communication (mail, telephone or email) that you would like to stop receiving from us. We will take commercially reasonable measures to comply with your request within a commercially reasonable time.

SECURITY OF YOUR PERSONAL INFORMATION

The security of your Personal Information is important to us. We, and the vendor(s) that host the Site and maintain the servers through which we provide the Services, take reasonable measures to secure your Personal Information from unauthorized alteration, access, use and disclosure. We follow generally-accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it.

We use a third party credit card processing company. We will only share with them (via SSL) your Personal Information that is needed to process your credit card payments, and they are prohibited from using your Personal Information for any other purpose.

No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially-acceptable means to protect your Personal Information, we cannot guarantee its security.

If you are a User, your Personal Information is accessible through entry of your user name and password on the Site. We recommend that you refrain from divulging your password to anyone. We will not ask you for your password during an unsolicited phone call or in an unsolicited email. Please keep in mind that whenever you disclose information online that information can be collected and used by others. Ultimately, you are responsible for maintaining the confidentiality of your password and other Personal Information.

EDITING & REMOVING YOUR INFORMATION & INFORMATION RETENTION

Subject to the Terms of Use and the provisions of this section, you may review and request modification and deletion of your Personal Information. We make requested changes and deletions to your Personal Information within a commercially reasonable time, but it may be impossible to remove your Personal Information completely, since it may remain in our backup files or logs. Please note that, if you request deletion of your Personal Information, you may be unable to utilize certain features of the Site and the Services.

Notwithstanding the above, we may preserve information about you, including (without limitation) your Personal Information in response to a legal demand or request if we have a good faith belief that the law requires us to do so. We may also preserve information about you, including (without limitation) your Personal Information, when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and/or to prevent death or imminent bodily harm. Information we receive about you, including (without limitation) your Personal Information, may be retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

ANONYMOUS INFORMATION & AGGREGATED DATA

Collection

When you access or use the Site, we collect general, non-personal information from you, including (but not limited to) your IP address, browser type, domain names, access times and referring website addresses (“Anonymous Information”). To gather Anonymous Information, we may use common tracking tools such as cookies. We use cookies to help you personalize your online experience, to enable us to provide quality Services through the Site and to provide general statistics regarding use of the Site. The purpose of a cookie is to tell a web server that you have returned to a specific page. For example, if you register with the Site, a cookie helps us to recall your specific information on subsequent visits. When you return to the Site, the information you previously provided can be retrieved to enhance the Services that we provide to you. You may also get cookies and other tracking technologies from third parties with links on the Site, as described in the THIRD PARTY WEBSITES & LINKS section below. We do not control cookies and other tracking technologies employed by third parties.

Opt-out

. You have the ability to accept or decline cookies from the Site. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Site or the Services.

Disclosure

. We may disclose aggregated Anonymous Information that has been collected from you and other users of the Site to our existing or potential vendors or other third parties, or in response to a government request or demand. We may also share aggregated and de-identified demographic data with third parties to enable the provision of targeted information, promotions, offers and discounts on our products and services.

THIRD PARTY WEBSITES & LINKS

We cannot control, and are not responsible for, any third party’s use of cookies, web beacons or other tracking technology that collect information about your or other visitors to or Users of the Site or other websites. Advertising agencies, advertising networks, and other companies who place advertisements on websites, email messages and on the Internet may use this or other technology to collect information about you. We encourage you to review the privacy policies of websites you choose to link to from website links that we provide through the Site (“Linked Sites”) or from any advertisements posted on the Site by third parties, so that you can understand how those websites collect, use and share your information. We are not responsible for privacy or security policies or practices of any third parties or their other websites.

YOUR CALIFORNIA PRIVACY RIGHTS

A California resident who has provided Personal Information to a business with whom she or he has established a business relationship for personal, family, or household purposes (“California Customer”) is entitled to request information about whether the business has disclosed her or his Personal Information to any third parties for the third parties’ direct marketing purposes. However, under the law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing customer’s Personal Information to third parties for their direct marketing purposes. Currently, we do not share your Personal Information with third parties for their own direct marketing purposes. California Customers may request further information about our compliance with California’s privacy law by sending us electronic mail at [email protected] or contacting us as stated below. Please note that we are only required to respond to one request per customer per year, and we are not required to respond to requests made by means other than through this e-mail address.

CHILDREN’S PRIVACY

The Site is not directed at children under 13 years of age, and we do not seek or knowingly collect any personal information about children under 13 years of age. If we become aware that we have unknowingly collected any personal information from a child under the age of 13, we will make commercially reasonable efforts to delete such personal information from our systems. If you are a parent or legal guardian and think your child under 13 has given us personal information, please contact us (see CONTACT US section).

VISITORS RESIDING OUTSIDE THE UNITED STATES

The Site is subject to U.S. laws, which may not afford the same level of privacy protection as laws in other countries. If you reside outside the United States, then the privacy laws and regulations in your country may be more protective of your Personal Information than those of the United States. We make no representation or warranty that this Privacy Notice and/or our privacy or security practices comply with the laws of any country outside of the United States.
